Hmm. Orochimaru's head isn't proof that he's dead. His ability to body jump
means that even if one body dies, or is even critically injured, he can jump
to another with the Curse Seal, including both Sasuke and Anko. Shikin
Fuujin is one of the very few moves that will kill him and prevent this and
only the Third and Fourth Hokages knew this.
This needs serious explanation.
Actually, there's been no statement that the Curse Seal is what allows him to body jump. From what was implied in recent manga chapters, the curse seal is the set up for it, but doing it requires a special jutsu, and, I highly doubt that critically injured, he'd be able to pull it off. More importantly, this fic appears to be ignoring the later manga chapters, so that probably doesn't apply.
And, I'd say Orochimaru can be killed without Shiki Fuujin, and one of the people who could do it is Naruto. (Orochi's clearly scared silly of him, or he wouldn't be so hot to make him dead. Another who could do it is Itachi, who Orochimaru is also scared of. (and, likely whoever else might be a member of Akatsuki.(I think that's the right spelling))
